Man sentenced to 20 years for aggravated burglary

XENIA — A Greene County man was sentenced to 20 years in prison Oct. 25 for burglarizing a Fairborn home with a deadly weapon.

Jevon C. Russell Jr., 27, was charged with the first-degree felony and firearms specification after he and another male allegedly forced their way into the Fairborn apartment April 10. Russell was accused of carrying two guns into the residence and stealing two hunting knives and a wallet off the coffee table.

Various witnesses took the stand during the three-day August trial, but defense attorney Charles Morrison argued that they were not credible and that DNA evidence was insufficient.

A jury found Russell guilty after deliberating for three hours.

Judge Michael Buckwalter ultimately sentenced Russell to 11 years for the aggravated burglary charge plus three years for the gun specification. The court also determined Russell to be a repeat violent offender, adding an additional two years to his sentence. Russell was convicted of aggravated robbery in 2008, court records indicate.

During a later bench trial, the court found Russell guilty of having weapons while under disability, a third-degree felony. This adds another three years to his total. The defendant was also on post-release control at the time of his offense for trafficking in drugs, which adds an additional year to his sentence.

The total comes to 20 years at the Ohio Department of Rehabilitation and Correction, of which 16 are mandatory.

“The significant penalty is warranted in this case,” assistant prosecutor David Hayes said. “He is a violent drug dealer. The City of Fairborn is safer because of the judge’s decision.”

Russell was being held in the Greene County Jail on a $100,000 bond. He is entitled to 198 days jail time credit, according to court records.
