Moore guilty on all counts of rape, GSI

XENIA — A Greene County jury found Anthony Moore, 36, of Xenia, guilty of five counts of gross sexual imposition, five counts of rape of a child under the age of 13 and three counts of rape by force — after deliberating March 9 for three hours.

Moore is facing five sentences of 10-to-life. He could receive three-to-58 years on the remaining counts, according to Assistant Prosecuting Attorney Alice DeWine.

DeWine said each gross sexual imposition charge carries a sentence of up to five years. Therefore, Moore could be sentenced up to 25 years alone on the gross sexual imposition charges. Charges for raping a child under 13 carry a sentence of 10-years-to life. Therefore, Moore could be sentenced to 50 years to life on those charges alone. Rape by force charges carry a sentencing of three-to-11 years each. If he were to receive the maximum sentence on those charges alone, he could be sentenced to 33 years.

If Moore is sentenced to the maximum capacity, he could receive 108-years-to-life. DeWine said she is expecting him to receive a significant sentence, adding that Judge Michael Buckwalter could not sentence him any less than 10-years-to-life due to the nature of the crimes.

“Tonight a Greene County jury returned multiple guilty verdicts against Anthony Moore for rape and gross sexual imposition,” DeWine said at the end of the trial. “On behalf of Greene County Prosecuting Attorney Stephen K. Haller, co-counsel David Hayes and victim advocate Cynthia Gevedon, I am so grateful that the juvenile victim received justice tonight. Her bravery ensures that no one else will have to suffer at the hands of Anthony Moore. The Xenia Police Division can be proud of their hard work.”

Over the course of the week, the jury heard from several witnesses, including the now-14-year-old girl. She testified that she was sexually assaulted “almost every day” between ages 11 to 13.

“The victim was brave to testify and all the professionals did an excellent job investigating the case,” DeWine said. “There’s justice here and I’m pleased with the results.”

Defense attorneys Adrian King and John Leahy argued the credibility of the girl, stating that there were conflicts in her statements and discrepancies in the timeline of when the alleged crimes took place. King said after the trial wrapped up that there will be an appeal on the case.

“It’s a very difficult case for everything involved … In a case like this, there’s never any winners,” King said. “It’s a rough day for the alleged victim and a rough day for my client. It’s a sad day all around.”

The victim’s family packed the courtroom March 9 to hear the verdicts.

Moore was being held in the Greene County Jail on a $150,000 bond with no 10 percent. Buckwalter will sentence Moore on Wednesday, April 4.
