XENIA — The man injured in an accident on U.S. Route 68 on Sept. 3 has died.

James Pendleton, 77, of Xenia and Florida, died at Miami Valley Hospital Sept. 11 as a result of the injuries he sustained when his vehicle was struck by a delivery truck.

According to the State Highway Patrol, Pendleton was traveling south on the road when he slowed, appeared to pull to the right and then make a U-turn in front of the truck. The driver of the truck, Cody Compton, 22, of Columbus, was unable to stop and struck the vehicle in the passenger side.

The investigation determined Pendleton was at fault, according to Lt. Doug Eck of the Xenia post of the state patrol. Charges are not expected, but the finished report will be presented to the Greene County Prosecutor’s Office for a final determination, Eck said.

This is the seventh fatal accident in the county this year, according to Eck. He said any accident that results in a death within 30 days is considered fatal for statistical purposes.

Compton had minor injuries, according to the highway patrol.
